Terms of Service

These Terms of Service ("Terms") govern your use of Kabayan VPN (the "Service"), operated by Kabayan VPN ("we," "us," "our"). By creating an account or subscribing, you agree to these Terms.

1. The Service

Kabayan VPN provides a virtual private network (VPN) connection intended to give subscribers a secure, encrypted link for private internet use. We provision an individual OpenVPN configuration file per paying subscriber.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and subscribe. By subscribing, you confirm this is the case.

3. Your Account

You're responsible for keeping your account credentials and VPN configuration file confidential. Your configuration file is personal to your account and licensed for use on one device at a time — don't share it with others. We reserve the right to suspend accounts showing signs of shared or abusive use.

4. Subscription, Billing & Cancellation

Subscriptions can be paid via GCash and other supported local payment methods, processed through our payment partner PayMongo, or via direct GCash transfer with manual confirmation. Each payment covers a fixed period (currently one month); there is no automatic recurring billing — you pay again to continue your access.

You can cancel anytime from your dashboard. Cancelling stops future billing and immediately ends your VPN access — see our Refund Policy for details on refunds.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law in your country, the Philippines, or elsewhere;
• Distribute malware, conduct unauthorized network scanning, or attempt to breach other systems;
• Send spam, phishing content, or unsolicited bulk communications;
• Infringe on the intellectual property or privacy rights of others;
• Circumvent this or any other service's rate limits, security, or fair-use protections.

We may suspend or terminate accounts that violate this policy, at our discretion, without a refund for the remaining period.

6. Service Availability

We aim for reliable uptime but don't guarantee the Service will be uninterrupted, error-free, or available at all times. Scheduled maintenance or unforeseen outages may occur.

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. We don't guarantee the Service will meet every use case or remain compatible with every third-party app or website.

8. Limitation of Liability

To the maximum extent permitted by law, Kabayan VPN is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
